TERMS OF USE OF THIS WEBSITE

By accessing this public website (hereafter referred to as the “SITE”) provided by Cascades Music Ensemble you agree to be bound by the following terms of use. Cascades Music Ensemble reserves the right to change these terms anytime.

Public Website Use

Cascades Music Ensemble grants you a limited, personal, non-transferable, non-exclusive license to use the SITE. You agree not to, for the benefit of yourself or a third party, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, reverse engineer, create derivative works from, build a product using ideas, functions, or graphics similar to, transfer, or sell any information, software, or products obtained from this SITE. You acknowledge and agree that the SITE and any necessary services used in connection with the SITE contain proprietary and confidential information that is the property of Cascades Music Ensemble and protected by intellectual property, copyright and other applicable laws.

You may view and use information and features from the SITE provided your use is solely for non-resale purposes and provided that no information obtained from the SITE is modified or altered in any way. No portion of any of the information provided on the SITE may be reproduced in any form whatsoever without the prior written consent of Cascades Music Ensemble. In the event that Cascades Music Ensemble is required to discontinue offering the SITE, or chooses to discontinue the SITE, you acknowledge and agree that Cascades Music Ensemble has no further obligation to you under any circumstances. In addition, Cascades Music Ensemble has the right to change or update any information or content available through the SITE without notice at any time.

You understands and agree that Cascades Music Ensemble will monitor your usage and any information or content transmitted by you through the System in order to: (i) comply with any applicable laws, rules, or regulations or other governmental orders; (ii) administer the SITE; and (iii) protect Cascades Music Ensemble, it’s students, yourself, and other users of the SITE.

Privacy Policy

No information that can uniquely identify an individual is gathered by merely visiting the public website. Personally identifiable information is only collected when you are register for a service.

Cascades Music Ensemble may use information you provide to fulfill your requests for our services, or to respond to your inquiries, or to offer you services. Personal data collected by Cascades Music Ensemble may be used for editorial, marketing, and promotional purposes to improve the SITE. Names and e-mail addresses may be added to Cascades Music Ensemble’s database future correspondences regarding the SITE. Cascades Music Ensemble does not rent or sell personal data. We may disclose personally identifiable information in response to a court order, subpoena, or request by a law enforcement agency. Visitors may opt-out of having their personal information collected or used by Cascades Music Ensemble by written request emailed to crock@cascadesrock.com.

The SITE is not intended for minors (persons under the age of 18). Cascades Music Ensemble does solicit personal information from minors without the written consent of the child’s parent or legal guardian. In the even Cascades Music Ensemble learns we have collected personal information from a minor without the written consent of that child’s parent or legal guardian, we will delete that information immediately.

CONDITIONS OF ENSEMBLE PARTICIPATION

By registering for participation in one of the ensembles you hereby certify that you have read, understood and agree to be bound by the following Conditions of Ensemble Participation.

Billing, Cancellation, & Other Fees

Session tuition (if any) is due by the start date of a session. Barring special circumstances, no refunds of tuition are offered after a session begins as a participant’s cancellation after a session begins has a negative consequence for the entire ensemble. Occasionally additional fees may apply for tickets and/or venue costs at the end of a session in order to fund the performance venue – the details of which shall be shared with all ensemble members as soon as possible.

Permission to use Photos, Videos, and Audio Recordings of Performances

Cascades Music Ensemble will never post or release the names of particpants without advanced consent. However, during performances your image, video, or audio recording may be taken and used in connection with promoting the Cascades Music Ensemble. Moreover you understand that friends and media personnel might also make similar recordings – and because many of these events are in public areas – Cascades Music Ensemble cannot control the distribution of those recordings either.

Tobacco, Drugs, & Alcohol Policy

All participants agree not to use, posses, distribute, purchase, or sell tobacco, controlled substances, prescription medications (unless directed by their physician), illegal drugs, or alcohol during their participation at ensemble rehearsals, performances, or associated events. Cascades Music Ensemble reserves the right to expel participants from the program who violate this policy.

Consent & Waiver

As partial consideration for your participation, you hereby agree to waive & release any claim or cause of action against the Cascades Music Ensemble, it’s affiliates (including music directors, instructors, managers, the George Family, the George Residence, and it’s landlords) from all liabilities and damages of any nature which you may sustain as a result of participating in the program. You understand that there may be risks associated with participation, both known & unknown, including potential loss of hearing, and you hereby agree to hold harmless and agree not to make any claim, suit or demand against the above mentioned parties. In addition you hereby certify that you are able to safely participate in program without threat to other participants or the above mentioned parties.

APPLICABLE LAW

You agree that the laws of the state of Oregon, without regard to principles of conflict of laws, will govern these TERMS OF USE OF THIS WEBSITE and the CONDITIONS OF ENSEMBLE PARTICIPATION and any dispute of any sort that might arise between you and Cascades Music Ensemble, or it’s affiliates (including music directors, instructors, managers, the George Family, the George Residence, and it’s landlords). If any provision of this Agreement shall be deemed invalid, the validity of the remaining provisions of this Agreement shall not be affected. You agrees that regardless of any statute or law to the contrary, any claim of action arising out of or related to Cascades Music Ensemble must be filed within one year after such claim or cause of action arose or be forever barred.
